Terms and Conditions

These terms are governed by and will be construed in accordance with the laws of Belgium and in extension the European Union. Any disputes arising under or in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the Belgian Courts.

We may update these terms from time to time. In case we believe that the changes are material, we will definitely let you know by posting an online bulletin and/or by sending you an email or message about the changed. By doing so we can inform you to make your decision whether you want to continue using our services.

Changes will be effective upon the announcement unless otherwise specified. You are responsible for viewing and becoming familiar with any changes. Your use of the services following the changes constitutes your acceptance of the updated terms.

We know and respect that your personal information is important to you, so it is similarly important to us. Our privacy policy details the handling of your information when you use our services. By using our services, you agree that we can process your information in the ways set out in the privacy policy.

To register a ZBOS Cloud account and use ZBOS Control, you must be at least 13 years old or lawfully permitted to enter into and form contracts under applicable law. In no event may minors submit content to the service without adult supervision. You agree that the information that you provide us upon registration, at the time of entering a trial or at the time of purchase, and at all other times will be true, accurate, current and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times. This is especially important with respect to your email address, since that is the primary way in which we can communicate with you about your account and our services.

Unless where otherwise noted, Talemate BV and/or its licensors own the intellectual property rights for all material on ZBOS Control and the underlying platform. All existing intellectual property rights are reserved.

For the purpose of these terms and conditions, "user-generated content" includes any projects, Compositions, Kiosk’s, Surveys, media, links to third party content and other submissions that a user could add to ZBOS Control and the underlying platform.

We encourage users to spread knowledge and creativity by freely sharing Compositions, Kiosks, Surveys and other content created with ZBOS Control. However, we also understand the need for individuals and companies to protect their intellectual property rights.
You are responsible for making sure you have the necessary rights, licenses, and/or permission for any user-generated content you submit to ZBOS Control and the underlying platform.

All user-generated content is provided as-is.
We do not provide any warranties about the accuracy or reliability of any user-generated content that is available on our platform. We do not endorse any views, opinions, or advice expressed in user-generated content.

We reserve the right to monitor all content and remove any content that can be considered illegal, inappropriate, offensive, or causes breach of these terms and conditions in any way.

We reserve the right to terminate your usage of our services at all times if we notice unauthorized, fraudulent or otherwise unlawful behavior, or any usage that contradicts our general terms and conditions. You can end your account at any time by contacting our customer services via the means stated below these terms and conditions.

Although we try our best, we can not guarantee that our services will be secure or available at any particular time or location, that any defects or errors will be corrected, that our services will be free of viruses or other harmful materials, or that the results of our services will meet your expectations. You use our services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not fully apply to you.

We may discontinue part of, or all of our services. We reserve the right to change, suspend, or discontinue any of the services at any time, for any reason. We will not be liable to you for the effect that any changes to the services may have on you, including your income, or your ability to generate revenue by using our services.
